code around here states that each seperate dwelling have its own hvac system

Get a carbon based filter, or install a Clean Effects. We have had good
success with both. You could always cut off his return duct, and redesign
your duct system. Who controls the thermostat. This set-up makes no sense.

Check with your local HVAC professional...there are carbon filters that can
be ordered that will help. They are not cheap, but if it does the job....
Maybe something like these....
