Penalties announced following fatal ammonia leak

WATERLOO --- State regulators have issued more than $1 million in
penalties for two companies following an ammonia leak at a Waterloo
meat processor that killed one employee and severely injured a second.

The Iowa Division of Labor Services this morning announced it has
proposed $1.16 million in citations and civil penalties for Beef
Products Inc. in the Aug. 31 accident at its plant that killed
Elizabeth "Liza" Myers, 44, of La Porte City.

Another $88,500 in citations was issued for Modern Engineering and
Piping, of Evansdale, which was working on the ammonia system at the
time.

Both companies have 15 working days to challenge the citations.

The state opened its investigation following the accident, and the
study was later expanded to cover BPI's entire facility.

Inspectors found 34 violations related to safety management, emergency
response, respiratory protection, alarms and lockout safety. It also
uncovered deficiencies in ammonia pipe and confined space labeling,
exit routes and a stair handrail.

MEP was cited for seven violations. Deficiencies included employee
safety training, lockout, safety management, respirator protection and
hazard communication.

Many of the violations were directly related to the fatal accident.

MEP workers were preparing to hook up a new ammonia piping system to
the existing BPI system, officials said. The leak started when a BPI
worker opened a high-pressure liquid ammonia valve which was not
locked out.

Myers, who had been with BPI for seven years, suffered inhalation and
contact burns.

She and another unidentified employee were taken to University
Hospitals and Clinics in Iowa City, and Myers later died.

Five or six other workers sought treatment for lesser injuries at
Waterloo hospitals.
